![]() ![]() Before decedent died, a decedent's gifts to the decedent's spouse, the decedent's subsequent purchase of land and deeding of the land in a corporate entity's name without documented consideration from the entity, and the decedent's involvement in the capitalization of the entity with purported funds from the spouse could all be found to constitute transfers made with the intent to fraudulently defeat claims of the decedent's ex-spouse under the terms of a settlement agreement the decedent had with the decedent's ex-spouse, and could constitute fraud under the statute.
